ACCEPTANCE OF THESE TERMS Please read these terms carefully before using, accessing, and ordering the FRENSOO App services and choices you have associated with this date. You accept and confirm that you have read, agree, and understood the following Terms & Conditions and consent to be bound by their content. If you do not agree to these terms, you cannot use and access the platform for any services. FRENSOO App services operate through a website, call center, and technology plate form (hereinafter referred to as the individual “Service” and collectively “Services”). These Terms of Use of FRENSOO App is a registered Handyman service under the laws of Pakistan. If you use the platform on behalf of an entity, you represent and guarantee that you have the power to bind that entity, your acceptance of the terms will be considered an acceptance by this entity, and "you" and "your" herein will refer to the entity. Our terms In these terms and conditions (which are referred to in this document as “these terms”), “Customer” means the customer (commercial and/or residential) for whom the Works are to be carried out by FRENSOO App. These can be Members or Non-Members. “FRENSOO App” means service providers which may be electrician, technician, cleaner or 3rd party contractor. 1 General • Quotations and estimated means, customer require quotes for estimated cost on required services. The quotation can be received through email, whatsup and visiting the office. The quotation will be based on the information provided by the customer. 1.1 The Customer acknowledges that FRENSOO App has not made any representations (other than any expressly stated in the Contract and/or in FRENSOO App’s estimate or Quotation), which have induced it to enter into the Contract, and the Contract shall constitute the entire understanding between the Customer and FRENSOO App for the performance of the Works. 1.2 No modification to the Contract shall be effective unless made by an express written agreement or email exchange between the parties. The signing on behalf of FRENSOO App of any documentation of the Customer shall not imply any modification of the contract. 1.3 Nothing in this Contract is intended to confer on any person any right to enforce any term which that person would not have. 2 Contractual relationship • Your access and use of the Services constitute your agreement to be bound by these Terms, which establishes a contractual relationship between you and Umbrella Online. If you do not agree to these Terms, you may not access or use the Services. These Terms expressly supersede prior agreements or arrangements, if any, with you. Umbrella Online may immediately terminate these Terms or any Services with respect to you, or generally cease offering or deny access to the Services or any portion thereof, at any time for any reason • 3. Pricing • FRENSOO App Schedule of Rates is available on www.frensoo.pk and at FRENSOO App’s premises during normal business hours. Our charges are listed in app and website. The visit charges are 500 4. Third Party Services and Content • 5. Refund No refund if services are started or our service provider reach at destination. For advance booking, please cancel your order 24 hours earlier to your schedule time. 6. Promotional Codes We will be offering promo codes but terms & condition will apply. 7. APPLICABLE LAW These terms are governed by and shall be construed in accordance with the laws of Pakistan. 8. WARNINGS Your use of the platform, pro services, or content will only be at your own risk. You acknowledge and agree that FRENSOO has no obligation, but reserves the right for any reason, to (a) monitor or review the content of the user; or (b) for any authorization purpose, verification of identity of conduct 9 Indemnity • The Customer shall indemnify FRENSOO App against all actions, suits, claims, demands, losses, charges, costs and expenses which FRENSOO App may suffer or incur in connection with a claim by any third party resulting from a breach of the Customers obligations, undertakings, representations and warranties in connection with this 10 Limitation of Liabilities o 10.1 FRENSOO will not be responsible for indirect, incidental, or indirect damages o 10.2. YOUR USE OF OR RELIANCE ON THE SERVICES OR YOUR INABILITY TO ACCESS OR USE THE SERVICES o 11 Force Majeure • FRENSOO App will use all reasonable endeavours to carry out the Works on the agreed dates but shall not be under any liability to the Customer if it should be either impossible or impracticable to carry out the Works on the agreed dates or at all, by reason of strike, lock out, industrial dispute, protests, storms, terrorism, act of god or any other event or occurrence beyond FRENSOO App’s control. • No waiver by FRENSOO App of any breach by the Customer shall operate as a waiver of any preceding or subsequent breach by the Customer. No variation shall be effective against FRENSOO App unless sanctioned in writing by FRENSOO App. No forbearance or delay on FRENSOO App’s part shall prejudice FRENSOO App’s rights and remedies under this contract.
